1. Acceptance of Terms

By accessing or using Active Gospel ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Active Gospel provides a sermon preparation workflow platform for pastors, church leaders, and ministry teams. The Service includes sermon research, outlining, manuscript drafting, discussion guide generation, social media content creation, and related ministry workflow tools. The platform is designed to assist, not replace, pastoral discernment and theological responsibility.

3. Eligibility

You must be at least 18 years old to use the Service. By agreeing to these terms, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a church or other organization, you represent that you have authority to bind that entity.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or are used for unlawful purposes.

5. Subscriptions and Billing

Certain features of the Service require a paid subscription. Subscription fees, billing cycles, and payment terms are disclosed at the time of purchase and may be updated with reasonable notice. All fees are non-refundable except as expressly stated in our cancellation and refund policy. We use third-party payment processors and do not store full payment card details.

6. User Content

You retain all ownership rights to sermon content, outlines, manuscripts, and other materials you create using the Service ("User Content"). By submitting User Content, you grant Active Gospel a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your sermon content and will not use it to train AI models or improve our services without your explicit consent.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe upon the intellectual property rights of others
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service in a manner that could damage, disable, or impair the platform
• Generate content that is unlawful, harmful, threatening, abusive, or discriminatory

8. AI-Generated Content Disclaimer

Active Gospel uses artificial intelligence to assist with sermon preparation tasks. AI-generated content is a tool to support pastoral work, not a substitute for pastoral judgment. You are solely responsible for reviewing, editing, and approving all content before use in any ministry context. We make no guarantees regarding the theological accuracy, completeness, or appropriateness of AI-generated material. Pastors should exercise discernment and ensure all content aligns with their denominational convictions and church doctrine.

9. Intellectual Property

The Service, including its software, user interface, branding, and underlying technology, is owned by Active Gospel and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our prior written consent.

10. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

11. Third-Party Services

The Service may integrate with third-party services (e.g., payment processors, AI model providers). We are not responsible for the practices of these third parties. Your use of integrated services is subject to their respective terms and policies.

12. Limitation of Liability

To the maximum extent permitted by law, Active Gospel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim. This limitation does not apply to liability that cannot be excluded under applicable law.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI-generated content will meet your specific ministry needs. Some jurisdictions do not allow the exclusion of implied warranties, so these exclusions may not apply to you.

14. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, including for violation of these terms or conduct that we determine could harm other users or the platform. Upon termination, your right to use the Service ceases immediately, but provisions of these terms that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will remain in effect.

15. Changes to Terms

We may update these Terms and Conditions from time to time. We will notify you of material changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated terms. The "Last Updated" date at the top of this page indicates when changes were last made.

16. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in California.
